1. Introduction
Welcome to Soomoja. These Terms of Service ("Terms") govern your access to and use of the Soomoja website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
Soomoja is a business verification platform that helps consumers verify the legitimacy of businesses in Kenya. We provide verified business profiles, QR code verification, and customer review systems.
2. Definitions
- "Business" refers to any entity registered on our platform for verification.
- "Consumer" refers to individuals using our platform to verify businesses.
- "Verification Badge" refers to the Silver or Gold certification we provide to verified businesses.
- "QR Code" refers to the unique scannable code assigned to verified businesses.
3. Eligibility
To use our Services, you must be at least 18 years old and capable of entering into a legally binding agreement. Businesses must be legally registered in Kenya and have valid documentation to apply for verification.
4. Business Verification
4.1 Application Process
Businesses applying for verification must provide accurate and complete information, including business registration documents, KRA PIN certificate, and owner identification. We reserve the right to request additional documentation.
4.2 Verification Tiers
We offer two verification tiers: Silver and Gold. Each tier has different features, benefits, and pricing as outlined on our pricing page. Features may be updated from time to time.
4.3 Verification Duration
Verification is valid for the subscription period purchased (typically 3 months). Businesses must renew their verification to maintain their status. Failure to renew will result in loss of verification badge and benefits.
5. Fees and Payment
Verification fees are as displayed on our pricing page and must be paid in full before verification is activated. We accept M-Pesa, bank transfers, and major credit/debit cards. All fees are non-refundable except as required by law or at our sole discretion.
6. User Conduct
You agree not to:
- Provide false or misleading information
- Use the Services for fraudulent purposes
- Attempt to copy, duplicate, or fake verification badges or QR codes
- Harass, abuse, or harm other users or businesses
- Submit false reviews or complaints
- Interfere with the proper functioning of the Services
- Violate any applicable laws or regulations
7. Reviews and Complaints
Users may submit reviews and complaints about verified businesses. All reviews must be honest and based on genuine experiences. We reserve the right to remove reviews that violate our guidelines or appear to be fraudulent.
We investigate complaints and may take action against businesses, including suspension or revocation of verification, based on our findings.
8. Intellectual Property
The Soomoja name, logo, verification badges, and all related materials are our intellectual property. You may not use, copy, or distribute these without our prior written consent, except as authorized for verified businesses displaying their verification status.
9. Disclaimer of Warranties
Our Services are provided "as is" without warranties of any kind. While we verify business documentation, we do not guarantee the quality of products or services offered by verified businesses. Consumers should exercise their own judgment when transacting with any business.
10. Limitation of Liability
To the maximum extent permitted by law, Soomoja shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services or any transactions with verified businesses.
11. Termination
We may suspend or terminate your access to our Services at any time for violation of these Terms or for any other reason at our sole discretion. Businesses may have their verification revoked for misconduct, false documentation, or failure to maintain proper business practices.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on our website and updating the "Last updated" date. Your continued use of our Services after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of Kenya. Any disputes arising from these Terms or your use of our Services shall be resolved in the courts of Kenya.
